DESCRIPTION OF THE OBLIGATION UNDER LEGISLATIVE DECREE 196/2003

In compliance with recommendation no. 2 adopted on 17 May 2001 by the European Authorities for the protection of personal data, the data controller is required to publish the privacy policy on its website, with particular reference to the so-called hidden processing, relating to users' navigation data.

Any collection of individual personal data obtained through a website requires the advance provision of certain information as provided for by art. 13 of the Code.
The obligation to provide information is governed by Article 13 of the Code. According to this provision, interested parties must be previously informed orally or in writing about:

a) the purposes and methods of processing for which the data are intended;
b) the mandatory or optional nature of providing the data;
c) the consequences of any refusal to respond;
d) the subjects or categories of subjects to whom the personal data may be communicated or who may become aware of them in their capacity as managers or persons in charge, and the scope of dissemination of the data;
e) the rights referred to in Article 7;
f) the identification details of the owner and, if designated, of the representative in the territory of the State pursuant to Article 5 and of the person in charge. When the owner has designated more than one person in charge, at least one of them is indicated, indicating the site of the communication network or the methods through which the updated list of persons in charge can be easily known. When a person in charge has been designated to respond to the interested party in the event of exercising the rights referred to in Article 7, this person in charge is indicated.

The GDPR has not changed the approach to privacy policies, integrating, where appropriate, the elements of the same with the new elements required for the information.

COOKIES

Legislative Decree 28 May 2012, n. 69 implemented the delegation provided for in art. 9 of the Community Law of 2010 (L. n. 217/2011) for the implementation of Community Directive 2009/136/CE1 (nicknamed Cookie Law or E-Privacy). This directive regulates the processing of personal data and the protection of privacy in the electronic communications sector.

The Decree regulates the use of information stored, often in an automated manner, through the use of so-called Web cookies, or Tracking cookies or Web beacons.
The objective pursued by the Community legislator, and subsequently by the national one, is to allow users to be informed in advance about the purpose and methods of collection of said information. The Decree requires website managers to ask for the explicit consent of the user in case they intend to proceed with the automated collection of the aforementioned information, if it is not strictly necessary for purely technical purposes and for the functioning of the site. The Decree provides for an exception to the general principle of collecting the user's consent for all those cases in which the release of cookies is, in fact, indispensable for navigation or for the use of a specific service or that access to the information is strictly necessary to provide the services explicitly requested by the user (for example the "Remember me next time you connect" function offered to the visitor).

The GDPR in recital 171 provides that “decisions of the Commission and authorisations of supervisory authorities based on Directive 95/46/EC remain in force until
are modified, replaced or repealed”. It can be rightly considered that the provisions of the guarantor authority therefore constitute, until modified, replaced or revoked, a reference to be observed in order to lawfully carry out the processing.

2.4 - Third party technical cookies

Privacy information pursuant to art. 13-14 of the European "Privacy" Regulation (GDPR)

The personal data entered by you are processed by CASA DI CURA IGEA Via Marcona, 69 – 20129 Milan (MI) for purposes related to the provision of the services requested by you (for example: request information, register on the site to receive benefits and offers, obtain estimates, make purchases and receive them at an address indicated by you).
